HIPAA Compliance

As required by the Office of Civil Rights (OCR), Presley Law & Associates enters into any and all business arrangements with a provider (covered entity) only after both parties sign a Business Associate Agreement for “a covered entity must impose specified written safeguards on the individually identifiable health information used or disclosed by its business associates.”

Presley Law & Associates legal team have taken steps to insure the privacy of information consisting of Protected Health Information (PHI). The Privacy Rule protects all “individually identifiable health information” held or transmitted by a covered entity or its business associate, in any form or media, whether electronic, paper or oral.

:: All records (paper and digital) are properly secured with no PHI accessible to non-employees of the company, unless they have completed a Business Associate agreement with the Presley Law Center.

:: All records (paper and digital) not retained are properly disposed of in compliance with HIPAA suggested procedures.

:: Network data cannot be accessed without proper security credentials. Network activity is logged, monitored, and tracked. PHI will not be divulged by employees of the Presley Law Center for any reason other than for the filing paper or electronic claims.

:: Any and all digital data transmitted via the Internet is done so utilizing secure encryption technology. PHI is never transmitted electronically without employing secure encryption technology.
